The son of a former “Real Housewives of Orange County” cast member accepted a plea deal Friday for a shooting outside a sober living home, allowing him to walk free after more than two years in local lockup.

Joshua Waring – who was facing a life sentence if convicted at an upcoming trial – pleaded guilty to a handful of charges, including assault, battery, and hit and run. He was sentenced to seven years and four months in prison but released on time already served in county jails.

Orange County Superior Court Judge Jonathan Fish said he believed Waring has changed and matured since the start of his criminal case. The judge described “two Josh Waring’s” – one a bright young man who led the way in fighting for his legal rights, the other an addict who in the past gave in to methamphetamine addiction.

“You’ve been a tough guy in jail, now you have to be a tough guy out here with that monkey on your back,” the judge told Waring.

In a handwritten note read to the court prior to Waring’s sentencing, the shooting victim wrote, “Josh, I forgive you. I wish you the best. Let it be in God’s hands. Don’t worry I’m not mad at you.”

After the hearing, Lauri Peterson – Waring’s mother and a former cast member on the “Real Housewives of Orange County” – said she was happy that “this chapter is closed.”

“We are just ecstatic to have him out of the system,” Peterson said. “He has been through so much. There will be a long recovery process.”

Peterson said her son’s time in jail had “broken his spirit.” She added that her number one priority with his release is helping him deal with his addiction issues.

“Josh is very bright, he is very capable,” Peterson said. “Unfortunately drugs took him at a very young age.”

While Waring’s criminal case has come to an end, the legal fallout continues to reverberate in the county jails and courthouses.

While preparing for trial, Waring’s attorney, Joel Garson, learned that at least 34,000 recordings of attorney client calls were made by the phone vendor for local jails, despite those calls being legally required to remain confidential.

Court hearings related to the jail call revelations included testimony by both deputies and their supervisors. Waring and his attorney allege that in retaliation deputies either set Waring up for attacks by other inmates or failed to protect him.

In June 2018, two deputies came into a jail module where Waring and other inmates were sleeping and fired off pepper balls.

More than a year later, Waring was attacked by an inmate wielding a blade in a jail housing area where inmates were supposed to be kept apart from each other.

Late last year, the Orange County District Attorney’s Office acknowledged they were looking into those incidents. Another inmate has since been charged with using a blade to attack Waring.

With Waring’s attorney contending that deputies were either unwilling or unable to protect Waring, Judge Fish took the rare step of moving Waring from county lockup to the Santa Ana City Jail while he awaited trial.

In recent months, Waring alleged that he was wrongly being held in solitary confinement at the city jail. Peterson said her son had long been “hell bent” on going to trial to prove his innocence, but after so much time in isolation had decided to accept the plea deal.

Waring had been accused of shooting a 35-year-old man outside a sober living home in Costa Mesa on June 20, 2016. Two other people escaped injury during the shooting. The motive for the shooting was unclear.

Garson said he appreciated the DA’s office, and District Attorney Todd Spitzer, agreeing to review the case prior to trial.

“It’s a compromise,” Garson said of the plea deal. “Josh needs to get on with his life and he wants to get out.”
